Protection against discrimination based on gender identity and sexual orientation – some of the most intimate personal characteristics – has become part of the EU legal system relatively recently. The Court of Justice of the European Union plays an important role in shaping this protection. Th e aim of this article is to assess the level of actual protection against discrimination on the grounds of gender identity and sexual orientation through a comparative analysis of the anti-discrimination judgments of the CJEU concerning the rights of unions of transsexual and homosexual persons. The research shows that transsexual people and their relationships enjoy a greater degree and scope of protection against discrimination in their relationships than homosexual people do.
