Unwritten Constitutional Principles in the Israeli Constitutional Law

This chapter examines the basic values underlying the democratic system of government in Israel as reflected in the fundamental unwritten constitutional principles in the Israeli constitutional law which is the creation of jurisprudence of the courts supported by the other branches of government. The chapter analyses selected key unwritten constitutional principles. This includes separation of powers, rule of law, human rights, the duty of public officers to act as public trustees, and the obligation of parliament to conduct due legislative procedure. The chapter discusses the fundamental principles upon which liberal democracy is based, including representativeness, stability, efficiency, accountability, governability, and public confidence in the government.
