The Role of Artificial Intelligence in the Management of Legal Records in the South African Judicial System

The internet has revolutionized many aspects of daily life, including trade, governance, and legal processes, presenting new regulatory challenges. Since the advent of the internet and the digitization of records, institutions have developed mechanisms to address emerging cyber-related challenges associated with these technologies. With the expansion of artificial intelligence (AI) in records management, cyberlaw challenges have emerged that require increased attention. Within the South African judiciary, the use of AI to manage legal records is still in its infancy. Still, it has progressed rapidly with advancements aimed at streamlining access to legal records. Through the application of a qualitative approach, following a case study design, views were gathered from experts in the fields of legal services and information and communications technology (ICT) to determine ways in which AI may be applied in the judiciary to advance judicial services. Through an interpretive paradigm, participants’ views identified varied, potential ways in which AI could be utilized within the judiciary to enhance legal services in South Africa. For example, potential roles of AI in the management of records in the South African judicial system may include legal research: AI-powered tools can assist legal professionals in conducting extensive research and analysis of legal precedents, case law, statutes, and regulations. This can help lawyers and judges access relevant information more efficiently, ultimately facilitating informed decision-making. Document management can be used to ensure the application of AI technology to organize and manage large volumes of legal documents, making it easier for legal practitioners to locate and retrieve information when needed. Additionally, AI-driven systems can streamline document review processes in legal cases, saving time and resources. Predictive analytics through AI algorithms can analyze historical legal data and trends to provide insights into case outcomes and potential risks. This information can assist lawyers in devising legal strategies and predicting possible judgments in specific cases.
