The Mechanism for Declaration of Enforceability in EU Family Law

Recognition and enforcement of foreign judgments are the means by which we can enforce our rights. It is an expression of mutual trust between the Member States of the European Union, which facilitates judicial cooperation and contributes to the effectiveness of the area of freedom, security and justice. In order to enforce a decision, some EU regulations still require a declaration of enforceability procedure to serve as a check that all the requirements have been met before the actual enforcement of the decision. However, this mechanism can also cause considerable delays in the proceedings. This paper will focus on the mechanism of the declaration of enforceability in EU family law regulations.
