The Architecture of NEC4

Waleed Tariq

This chapter introduces the NEC4 Engineering and Construction Contract from first principles, covering its origins, its design philosophy, and the five-layer structure that organises every contract in the suite. It also locates the ECC within the wider NEC4 family of contracts that share that design philosophy. The chapter traces the NEC suite from its 1993 first edition through NEC3 to the 2017 publication of NEC4, the dominant standard form in UK public sector construction. It identifies the design choices that distinguish NEC from FIDIC and JCT. Three features stand out. NEC4 is drafted in plain English in the present tense. It is management-oriented, placing the Project Manager and the Contractor in a real-time partnership. And it is modular, so the contract can be tailored without disturbing its backbone. The chapter then sets out the five layers in turn. These are the nine sections of Core clauses, the chosen Main Option, the dispute resolution option, the Secondary Options, and any Z clauses. Each is signposted to the chapter where it is administered in detail.
