ON THE ESSENCE OF THE TRANSFORMATION OF CRIMINAL PROCEEDINGS UNDER SPECIAL CONDITIONS
Dmitry SafronovThe article analyzes the criminal procedural legislation of the Russian Federation in terms of its applicability under special conditions: specifically, martial law, a state of emergency, and a counter-terrorism operation. The author concludes that the current framework is peacetime legislation, as it lacks the criminal procedural mechanisms necessary to conduct operations under such special conditions. A proposal is being submitted to supplement the law with provisions outlining the specifics of criminal proceedings under special conditions, in order to ensure the application of criminal procedural rules in strict accordance with the law.
