MECHANISM OF CHILD SEXUAL EXPLOITATION MATERIAL OFFENCES IN DIGITAL ENVIRONMENT

Murat Zhakupbekov

The study aims to clarify the mechanism of criminal activity involving the production, storage and distribution of child sexual exploitation material, where a single user operation triggers a chain of automated system actions. The methodology combines formal legal analysis of the Criminal Code and the Criminal Procedure Code of Kazakhstan, comparative study of foreign approaches to cloud data storage, and forensic analysis of trace formation in distributed systems. The mechanism is defined as a distributed and dynamically changing system of volitional acts of a person, automated operations technically connected with them, changes in the state of digital material, and the resulting traces. The article proposes a five-component model of conscious digital behaviour, a grouping of alternative explanations for the appearance of a file, and a shift from the storage medium to a chain of digital events as the unit of forensic examination.
