LGBT-Supportive Policies: A Call to Action Among Chief HR Officers

Abstract

While the Supreme Court extended Title VII protections to include sexual orientation and gender identity, other forms of discrimination, such as harassment, remain insufficiently addressed. Sexual orientation and gender identity minorities face pervasive discrimination, harassment, and violence. The current federal gaps in legislation and a fragmented patchwork of state nondiscrimination laws leave lesbian, gay, bisexual, and transgender (LGBT) workers with uneven protections. Diversity, equity, and inclusion (DEI) initiatives are now facing political backlash, some companies have chosen to abandon LGBT-supportive policies. This chapter discusses LGBT-supportive policies as both a strategic imperative and a moral obligation for organizations. It advances a business case that emphasizes competitive advantages such as stronger customer relationships, enhanced reputation, risk mitigation, and financial performance, alongside a moral case that highlights reduced discrimination, improved well-being, and greater employee engagement. The chapter also calls on Chief HR Officers (CHROs) to take the lead in reinforcing LGBT-supportive policies and driving inclusive workplace cultures.
