Innovation and the Governance of Outer Space as a Commons

The commercialization of outer space has accelerated faster than any other global commons, yet governance remains tethered to static frameworks designed by twentieth-century global institutions and national governments. This article examines how technological innovation endogenously reshapes commons attributes at a pace that destabilizes existing institutional models. Through comparative analysis of six technological domains (space transportation, in-space manufacturing, bioproduction, agriculture, nuclear propulsion and disposal, and satellite services), we identify sector-specific dynamics of congestion, market concentration, and undersupplied public goods. Our framework demonstrates that governance challenges arise less from fixed resource characteristics than from feedback loops between innovation development and institutional design. The findings advance three contributions: a conceptual model of shifting commons attributes, sectoral diagnoses of emerging coordination failures, and prescriptions for adaptive governance architectures, including modular treaties, polycentric arrangements, and public-private partnerships.
