Ideological Polarization and Pedagogical Approaches for Teaching Legal Diversity Topics in Resource Management Courses

Public administration faculty teaching Human Resource Management find themselves forced to adapt to the impact of ideological polarization on their teaching. This includes incorporating important DEI issues. These issues include Equal Employment Opportunity Law (EEO) and diversity jurisprudence issues, including Title VII disparate impact law. On April 23, 2025, President Trump issued Executive Order 14281, “Restoring Equality of Opportunity and Meritocracy.” The order directed all federal agencies to halt disparate-impact enforcement actions. The article proposes several approaches for faculty teaching Human Resource Management to meet the NASPPA accreditation standard requiring that students demonstrate the ability to “communicate and interact productively and in culturally responsive ways with a diverse and changing workforce and society at large.” The article also discusses First Amendment classroom freedom-of-speech rights of public college and university faculty who teach DEI issues in Human Resource Management (HRM) courses, as well as the limitations on those protections. The article argues that faculty members teaching public-sector (HRM) have several options for addressing Diversity, Equity, and Inclusion (DEI) issues, including Title VII disparate-impact jurisprudence, in their HRM courses.
