EFFECTIVENESS OF LEGAL RESTRICTIONS IN MODERN PUBLIC AND PRIVATE LAW

The article examines the content of the concept of “efficiency” in relation to legal restrictions. It has been established that the effectiveness of legal restrictions is divided into social and formal legal. It is substantiated that the social and formal legal effectiveness of legal restrictions are interconnected in both public and private law. The author comes to the conclusion that the effectiveness of private law is influenced by the effectiveness of those restrictions that are aimed at curbing possible offenses on the part of government officials. It is noted that the effectiveness of private law and the restrictions applied within the framework of its mechanism of action do not have any impact on the effectiveness of the latter in public law.
