Defects and Quality Management
Waleed TariqThis chapter covers the quality mechanisms in NEC4 under clauses 40 to 46, anchored on the clause 11.2(6) definition of a Defect. The chapter contrasts the proactive system around which the contract is built with the reactive defects-policing model used by traditional forms. The clause 40 quality management system, the tests and inspections framework at clauses 41 and 42, and the Supervisor’s search power at clause 43 are set out in turn, alongside the mutual duty under clause 43.2 to notify a Defect and the Contractor’s clause 44.2 obligation to correct it within the defect correction period. the Defects Certificate at clause 44.3 starts the four-week clock for the clause 53 final assessment. Clause 45 governs acceptance of a Defect by Scope change, and clause 46 sets out the Project Manager’s two-track remedy where a Defect is left uncorrected. Design defects and the skill-and-care standard under Option X15 are addressed last.
