Contract Data, Scope and Day-one Setup

Waleed Tariq

This chapter treats the Contract Data and the Scope as the operating manual of every NEC4 project. Contract Data Part One is the Client’s responsibility, setting the Main, dispute resolution, and secondary Options, the named Project Manager and Supervisor, the period for reply, the Completion Date, and the populated Early Warning Register. Part Two is the Contractor’s responsibility, setting the fee percentage, key persons, the activity schedule or Bill of Quantities, and the tender programme. The Scope is then examined as the document that defines the works, alongside the design liability standard under Option X15, the applicable law trap, and the contra proferentem rule in clause 63.10, which allows a Contractor to bank ambiguities until after the Contract Date. The Site Information is separated from the Scope, with the ‘for information only’disclaimer and informal data room workarounds addressed as patterns that cost the Client more than honest disclosure would. The chapter closes with a contract start-up checklist anchored to the window between the Contract Date and the starting date, including the clause 84.1 insurance certificate workflow.
