ARTICLE 264 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION IN LAW ENFORCEMENT PRACTICE: FROM GENERAL SITUATIONS TO PARTICULAR CIRCUMSTANCES (ON THE EXAMPLE OF JUDICIAL PRACTICE)
Tamara Kovaleva, Ekaterina KashkinaThe article provides an analysis of situations of violation of traffic rules and vehicle operation, which allow to identify objective signs of the crime under Article 264 of the Criminal Code of the Russian Federation. Through the mandatory signs, including the cause of the connection, a particular act is qualified in order to meet the requirements of Article 264 of the Criminal Code of the Russian Federation. The authors highlight the mandatory conditions that must be taken into account when establishing the truth in a traffic accident case. Based on judicial practice, the authors conclude that it is necessary to consider the individual characteristics of a particular act when forming the evidence base.
