ANALYSIS OF THE LEGAL INSTRUMENTS ON WATER POLLUTION IN NIGERIA

The challenges of water pollution have advanced into a severe menace in Nigeria, it has caused deaths and irreparable loss of lives and living. The accumulation of synthetic chemicals and waste in groundwater and surface water has posed a snowballing peril to future development. The prevalence of water pollution is alarming, this problem has given rise to this paper which takes a purview at the legal apparatus in addressing water pollution and ascertaining the right to clean water and the environment. This paper aims at discussing ways and methods to curtail water pollution in Nigeria and how environmental legislation can effectively tackle this challenge that threatens the quality of water. The methodology adopted is a doctrinal and analytical approach. The paper made use of primary and secondary sources which include local and foreign legislation, case laws, textbooks, journal articles, newspapers, and internet materials. The findings point significantly to the apparent weakness of the enforcement mechanisms of environmental legislation in Nigeria. The conclusion drawn from the foregoing is that if the provisions of the relevant laws are perfected and diligently implemented, there would be fewer water pollution issues to address. In this regard, this paper recommended, amongst others, the review of existing laws on water pollution to make them more effective by way of enforcement in tackling the progressing water pollution challenges. The work also emphasizes strengthening the enforcement mechanisms to achieve the maximum result.
