We report the use of 1,3-benzoxazine for a Rh(

iii

)-catalyzed cascade [3+2]-annulation with nitroalkenes, affording diverse nitro-substituted N -indene-tethered benzyl alcohols through formation of two C–C bonds and cleavage of the C2–O bond.
